Senior Commercial Counsel
My client, a clinical-stage biopharmaceutical company, is seeking a Senior Commercial Counsel to join its legal team, as they prepare for the launch of their first commercial product. This is a pivotal time to join an already well established company where you will serve as a strategic advisor across the product lifecycle, partnering with cross-functional teams to ensure compliant and effective commercialization.
Responsibilities
- Negotiate, draft, and review market access and customer-facing agreements, including distribution, PBM, GPO, wholesaler, rebate/discount, and specialty pharmacy contracts
- Provide legal guidance on product development, launch, and commercialization activities
- Advise on healthcare regulatory matters, including promotion, labeling, and interactions with healthcare professionals
- Review and approve marketing and scientific materials
- Partner with commercial, medical, regulatory, and clinical teams to manage legal risk
- Counsel on healthcare laws (e.g., FDCA, Anti-Kickback Statute, FCA, HIPAA)
- Conduct risk assessments and deliver practical, business-oriented solutions
Qualifications
- J.D. and active bar membership in at least one U.S. jurisdiction
- 5+ years of legal experience in a law firm and/or in-house within life sciences or healthcare
- Experience supporting pharmaceutical or biotech commercialization preferred
- Strong communication, analytical, and drafting skills
- Ability to thrive in a fast-paced, growth-oriented environment
