Commercial Litigation & Class Action Attorney

A nationally recognized law firm is seeking an experienced Commercial Litigation & Class Action Attorney to join its growing litigation practice in Chicago. This opportunity is ideal for a highly motivated attorney seeking sophisticated litigation work, significant responsibility, meaningful client interaction, and long-term career growth within a collaborative and entrepreneurial environment.

The successful candidate will play a key role in managing complex commercial litigation and class action matters in state and federal courts nationwide. This position offers the opportunity to work on a broad range of sophisticated disputes, including commercial litigation, privacy and data breach claims, consumer class actions, and other high-exposure litigation matters.

Attorneys with experience in class actions, cybersecurity, privacy litigation, or technology-related disputes are particularly encouraged to apply; however, strong commercial litigation and class action experience remains the primary qualification.

Key Responsibilities

  • Manage all phases of complex commercial litigation and class action matters in state and federal courts.
  • Defend class action lawsuits, including privacy, consumer, and data breach-related claims.
  • Develop and implement litigation strategy for sophisticated disputes and high-exposure matters.
  • Draft and argue substantive motions, including:
    • Motions to dismiss
    • Motions to strike
    • Class certification and class certification opposition motions
    • Motions for summary judgment
    • Other dispositive motions
  • Conduct legal research and prepare persuasive briefs, memoranda, and court filings.
  • Manage written discovery, e-discovery, document review, and production processes.
  • Take and defend fact, corporate representative, and expert witness depositions.
  • Collaborate with expert witnesses and consultants to support case strategy.
  • Represent clients in court appearances, hearings, mediations, arbitrations, and settlement conferences.
  • Participate in settlement negotiations and draft settlement-related documentation when appropriate.
  • Coordinate litigation strategy across multiple active matters while maintaining excellent client service and meeting critical deadlines.
  • Work closely with clients, partners, and litigation teams to achieve successful outcomes.

Qualifications

  • J.D. from an accredited law school.
  • Active admission to the applicable state bar.
  • Minimum of 5-15+ years of complex commercial litigation experience.
  • Significant experience litigating matters in state and federal courts.
  • Experience managing all aspects of litigation, including discovery, depositions, motion practice, and case strategy.
  • Strong legal research, writing, analytical, and oral advocacy skills.
  • Demonstrated experience drafting sophisticated motions, briefs, and other substantive filings.
  • Proficiency using legal research platforms such as Westlaw and LexisNexis.
  • Strong organizational skills and the ability to effectively manage multiple matters simultaneously.
  • Ability to work independently while thriving in a collaborative team environment.

Preferred Qualifications

  • Experience handling class action litigation matters.
  • Experience defending privacy, cybersecurity, and data breach claims.
  • Familiarity with privacy-related statutes and regulations, including:
    • BIPA (Biometric Information Privacy Act)
    • CIPA (California Invasion of Privacy Act)
    • VPPA (Video Privacy Protection Act)
  • Other privacy and consumer protection laws
  • Experience with multidistrict litigation (MDL) proceedings.
  • Background in technology, privacy, cybersecurity, or other emerging litigation areas.
