Senior Product Counsel
Job Overview
We are partnered with an established, tech-driven consumer financing company looking to further expand its growing legal team with a talented Product Counsel. This fully remote position will ensure compliance with digital and traditional consumer lending product roll outs and advertising, as well as assisting cross-functional teams in general state and federal regulatory obligations across the business. In this role, you will be a key factor across mutliple business lines while earning a market competitive compensation package and work completely remote with little travel requirements.
Job Responsibilities
- Represent Legal on cross-functional teams to help design and implement financial products, identify creative solutions to unique use cases and escalated issues, and ensure compliance with financial regulations and other applicable laws, partner contracts, card brand rules, and industry best practices.
- Review customer-facing materials, including multi-channel advertising, and user experience content, for compliance with federal and state laws and best practices, and provide feedback and guidance to stakeholders.
- Advise on state and federal regulatory matters, including the engagement and management of outside legal counsel when necessary.
- Continuously monitor and maintain comprehensive knowledge of consumer lending and other applicable laws/regulations for a multi-state consumer finance company with numerous locations and a digital platform.
- Preparation of legal documents including loan contracts and related documentation, software service agreements, non-disclosure agreements, and other commercial and related agreements.
- Work cooperatively and strategically with other departments to advise on matters consistent with applicable laws and regulations, including closely assisting with state and digital expansion efforts.
Job Qualifications
- Law degree and admitted to a state bar
- Knowledge of the following laws and regulations: Uniform Commercial Code (UCC) Article 2 and Article 9; Unfair, Deceptive or Abusive Acts or Practices (UDAAP) principles; Federal Trade Commission Act; Truth in Lending Act (TILA/Reg. Z); Fair Credit Reporting Act (FCRA/Reg. V); Fair Debt Collection Practices Act (FDCPA); Equal Credit Opportunity Act (ECOA/Reg. B); CAN-SPAM Act; Telephone Consumer Protection Act (TCPA); you
- At least 3 to 5 years of experience in the legal field
- Experience advising clients with respect to legal issues arising in consumer lending, technology, consumer protection, financial services and operations
