Director/Senior Director, Commercial Counsel
- Serve as lead legal counsel to multiple product and pipeline brand teams, providing proactive, business-oriented legal guidance across the product lifecycle
- Advise on launch strategy, pre-launch readiness, and in-line commercialization activities, including lifecycle management and market expansion initiatives
- Partner with Commercial leadership to support strategic brand planning, messaging, and execution
- Provide legal review and guidance on promotional and non-promotional materials through MLR/PRC processes
- Counsel on advertising, digital engagement, social media, and scientific exchange activities
- Ensure materials and communications align with FDA regulations, PhRMA Code, and company policies
- Advise on interactions with Healthcare professionals (HCPs), Patient advocacy organizations, Payers and reimbursement stakeholders
- Support speaker programs, advisory boards, consulting arrangements, and patient support programs
- Provide legal guidance on market access strategies, including payer engagement, pricing considerations, and patient access initiatives
- Draft, review, and negotiate a broad range of agreements, including HCP/HCO consulting and services agreements, Advisory board agreements, Market access and commercial agreements, Sponsorships and patient support program contracts
- Interpret and apply key healthcare laws and regulations, including, FDA (FDCA), Anti-Kickback Statute (AKS), False Claims Act (FCA), OIG guidance and industry codes
- Advise on risk mitigation strategies across commercialization activities
- Partner closely with Compliance to ensure aligned, consistent guidance
- Collaborate with Commercial (Marketing, Sales), Medical Affairs, Market Access, Regulatory, Compliance, and Privacy
- Act as a trusted advisor to senior leaders, translating complex legal requirements into practical business guidance
- Support training and education initiatives for business stakeholders on key legal and compliance topics
- JD from an accredited law school; active bar membership
- Director: 8-14+ years of relevant legal experience
- Significant in-house pharmaceutical, biotechnology, or healthcare legal experience
