Job Title: Senior Legal Counsel - Ecommerce Sourcing
As a Senior Legal Counsel, you will play a vital role in providing legal guidance and support across various aspects of the business operations. Your primary responsibility will be to offer expert legal advice and ensure compliance with relevant laws and regulations in relation to commercial transactions, supplier and seller relationships, labor matters, and other legal aspects of the business.
Responsibilities:
1. Provide legal advice and guidance: Offer timely and accurate legal advice to internal stakeholders on a wide range of legal matters related to daily business operations, commercial transactions, and contractual agreements.
2. Compliance management: Ensure compliance with applicable laws, regulations, and company policies in all business activities, including but not limited to labor laws, consumer protection laws, intellectual property laws, and data protection laws.
3. Contract negotiation and drafting: Review, draft, and negotiate various commercial contracts, including supplier agreements, seller agreements, service agreements, and other related contracts to protect the interests of the company.
4. Supplier and seller management: Collaborate with cross-functional teams to manage relationships with suppliers and sellers, including the recruitment and termination of suppliers, conducting due diligence, and ensuring compliance with contractual obligations.
5. Dispute resolution: Assist in the resolution of legal disputes, including managing litigation and arbitration processes, engaging external legal counsel when necessary, and representing the company's interests in negotiations and settlements.
6. Risk assessment and mitigation: Identify potential legal risks and provide proactive strategies to mitigate those risks, ensuring the protection of the company's interests and reputation.
7. Stay updated on legal developments: Keep abreast of relevant legal and regulatory developments in the ecommerce industry, assess their impact on the business, and provide recommendations for necessary adjustments to policies and procedures.
8. Training and awareness: Conduct training sessions and workshops to enhance legal awareness among employees, ensuring compliance with legal requirements and fostering a culture of ethics and integrity.
Qualifications:
1. Legal expertise: Possess a law degree or equivalent from a reputable law school. Admission to the bar or relevant legal association is required.
2. Experience: Minimum of 8 years of experience as a legal counsel or attorney, preferably with expertise in ecommerce, commercial law, or related fields. Prior experience in a multinational or retail industry is highly desirable.
3. Knowledge of laws and regulations: Strong knowledge of Chinese laws and regulations related to ecommerce, labor, contract, consumer protection, and intellectual property rights. Familiarity with international legal frameworks and practices is an advantage.
4. Contract drafting and negotiation: Proven experience in drafting and negotiating complex commercial agreements and contracts. Ability to identify and address legal risks, ensuring favorable terms and conditions for the company.
5. Analytical and problem-solving skills: Excellent analytical skills and the ability to think critically to identify legal issues, evaluate risks, and develop practical solutions.
6. Communication and collaboration: Strong interpersonal and communication skills to effectively collaborate with cross-functional teams, senior management, external legal counsel, and stakeholders at all levels.
7. Integrity and ethics: High ethical standards, discretion, and the ability to handle confidential information with utmost professionalism and integrity.
8. Language proficiency: Proficient in both written and spoken English and Mandarin Chinese. Additional language skills are advantageous.
